CERTIFIED
AS-BUILT PLOT PLANS
For
all new buildings/structures a certified, as-built plot plan is
required to be submitted to the Building Department once the foundation
has been installed and certified by a registered land surveyor as
to the as-built location of the foundation structure.
If
an addition to an existing build/structure is within close proximity
to the required setback from the property lines, a certified, as-built
plot plan must be submitted to the Building Department once the
foundation has been installed and certified by a registered land
surveyor as to the as-built location of the foundation structure.
In the cases, the requirement to have an as-built plot plan is solely
the decision of the Building Inspector. In ALL variance cases, when
a setback variance has been approved, a certified as-built plot
plan is required.

EXEMPTION & RESPONSIBILITY
Does a homeowner
need to be licensed to perform work on his/her own property at which
he/she resides, or intends to reside?
No. Massachusetts State Regulation (Building Code) exempts homeowners
from being licensed. Homeowner

If a homeowner
takes out a permit in his/her name, and the owner is listed as the
contractor and subcontracts the work out. Who is responsible under
the building code for the construction work being performed?
The parties listed as the contractor is responsible. In this
case it is the HOMEOWNER.
CONTRACTORS
SUPERVISOR
All
contractors who perform work governed by the state building code,
for which a license is required, and who are listed on the building
permit as the contractor, must employ a licensed construction supervisor.
His/her license number and name must appear on the building permit
application.

COMPANIES
In
addition to the requirement for contractors employing an individual
having a licensed construction supervisor license, those contractors
performing alterations, remodeling or additions to owner-occupied
dwellings of six units or less, are required to also have a Home
Improvement Contractors Registration. The contracting company, in
this case, would be required to be licensed.
EXEMPTIONS
When
constructing new homes and buildings containing up to six units
a Home Improvement Contractor Registration is not required. ALSO,
homeowners performing their own work are exempt.
HOMEOWNER
EXEMPTION FORM
If
the homeowner is going to do his/her own work, then the homeowner
will be required to fill out the Homeowners License Exemption form.
